Al Ain Court of Civil, Commercial, and Administrative Cases dismissed a lawsuit filed by a divorced woman against her ex-husband, in which she demanded that he repay her Dhs297,925, which she claimed she had transferred to him as a loan, as evidenced by bank transfer statements and account records.
She also sought a 12% delay interest from the date of filing the lawsuit until full payment, as well as Dhs50,000 in compensation for material and moral damages, along with legal fees and expenses.
The plaintiff attached bank account statements to her lawsuit.
The appellee’s lawyer argued that he had previously filed a lawsuit to compel the plaintiff to pay amounts she owed to her ex-husband, and a judgment had been issued in his favour, ordering her to pay him Dhs80,000.
The court stated that the plaintiff claimed the transferred amounts to her ex-husband were loans, and she presented witnesses, two of whom were heard by the court. However, their testimonies were insufficient to prove the plaintiff’s claim.
The court added that the financial transfers to the appellee were made in installments over extended periods and on various dates, with multiple possible reasons for these transactions.
Therefore, the court dismissed the witnesses’ testimony.
The court further noted that a previous court ruling had already obligated the plaintiff to pay her ex-husband Dhs80,000 during the same period, and she had not provided any evidence to support her claims. Consequently, the court rejected the lawsuit.
