Abu Dhabi Family, Civil, and Administrative Cases Court ordered a man to return Dhs80,000 and fined him Dhs5,000 in favour of another man, after he was convicted of misappropriating the plaintiff’s funds after mistakenly transferring the amount to him.
In the details, a man filed a lawsuit against another, alleging that the latter had seized his money after mistakenly transferring Dhs80,000 to the appellee’s account. The plaintiff noted that the appellee had been convicted in a criminal case.
The plaintiff demanded that the appellee be obligated to return the Dhs80,000 along with legal interest at 5% per annum from the date of the judicial claim until full payment.
Additionally, the plaintiff sought Dhs10,000 in compensation for material and moral damages he incurred, as well as the reimbursement of court fees, expenses, and attorney fees.
The court clarified that it was established that the plaintiff had previously filed a complaint with the competent authorities against the appellee, who was subsequently referred to criminal court on charges of misappropriation following an erroneous bank transfer.
A conviction was issued against the appellee and the judgment became final as per a certificate from the Public Prosecution confirming no appeal was filed.
Consequently, the court found the appellee at fault and ordered him to return the Dhs80,000 to the plaintiff.
The court also noted that the appellee’s error caused the plaintiff material and moral damages, so the appellee was ordered to pay the plaintiff Dhs5,000 in compensation for all damages.
